BYBORDER TERMS AND CONDITIONS

Welcome to ByBorder (the "Application"). These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and Sky Stork sp. z.o.o. ("Operator", "we", "us", or "our") governing your access to and use of the ByBorder mobile application and related services.

By downloading, installing, or using the Application, you agree to be bound by these Terms. If you do not agree to these Terms, do not install or use the Application.

1. LEGAL ENTITY AND GOVERNING LAW

1.1. The Application is operated and published by Sky Stork sp. z.o.o., legal entity registered in Poland.

1.2. These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law principles.

1.3. Any disputes, controversies, or claims arising out of or in connection with these Terms or the use of the Application shall be submitted to the exclusive jurisdiction of the competent courts located in Warsaw, Poland.

2. ELIGIBILITY AND AGE RESTRICTIONS

2.1. You must be at least 16 years old to use this Application. By using the Application, you represent and warrant that you are at least 16 years of age and have full legal capacity to enter into this agreement.

2.2. If you are under 16 years of age, you are strictly prohibited from downloading, installing, or using the Application.

3. SERVICES AND USER ACCOUNTS

3.1. The Application provides users with real-time geolocation-based estimates, predictive analytics, monitoring of queue waiting times at border crossings, and optional travel history management.

3.2. To access the Application and its features, users must sign in using a Google Account via Google Sign-In. The Operator processes basic profile information (such as Google Account ID and primary email address) solely to authenticate users, manage personal accounts, and deliver personalized services.

3.3. By authenticating and enabling location-based services, users can record and view their personal border crossing history within their profile. Location traces linked to a user's account are stored to provide this history. Users maintain full control over their personal data and may request full account and/or their personal data deletion at any time through the profile settings.

3.4. Access to the Application’s core features is currently provided free of charge. The Operator reserves the right to introduce paid features, premium subscriptions, or advertisements in future updates upon updating these Terms.

4. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

4.1. ALL FORECASTS, QUEUE TIME ESTIMATES, BORDER STATUSES, AND ANALYTICS PROVIDED WITHIN THE APPLICATION ARE FOR INFORMATIONAL AND GENERAL REFERENCE PURPOSES ONLY.

4.2. BORDER CROSSING CONDITIONS, WAITING TIMES, AND OFFICIAL PROCEDURES ARE SUBJECT TO RAPID CHANGE DUE TO BORDER GUARD OPERATIONS, WEATHER, STRIKES, ROAD CLOSURES, OR OTHER UNFORESEEN CIRCUMSTANCES. THE OPERATOR DOES NOT GUARANTEE THE ACCURACY, COMPLETENESS, TIMELINESS, OR RELIABILITY OF ANY QUEUE ESTIMATES OR PREDICTIONS.

4.3. To the maximum extent permitted by applicable law, the Operator and its affiliates, officers, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages, including but not limited to:

5. PROHIBITED CONDUCT AND FAIR USE

5.1. To ensure the accuracy of queue calculations for all users, you agree not to engage in any activity that tampers with or manipulates geolocation data.

6. USER FEEDBACK AND PRIVACY

6.1. The Application may allow users to voluntarily submit feedback or private status reports regarding border crossing experiences.

6.2. Any feedback, metrics, or reports submitted by you shall be used strictly for internal algorithm optimization, quality improvement, and statistical verification by the Operator. Feedback will NOT be published publicly.

6.3. Your privacy is essential to us. The collection and processing of personal data are strictly governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. INTELLECTUAL PROPERTY

7.1. All rights, title, and interest in and to the Application, including software code, UI design, algorithms, logos, database rights, and trademarks, are and remain the exclusive property of the Operator.

7.2. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Application solely for personal, non-commercial purposes in accordance with these Terms.

8. CHANGES TO TERMS AND SERVICE MODIFICATIONS

8.1. We reserve the right to modify or update these Terms at any time. Updated Terms will be posted within the Application with a revised "Last Updated" date. Your continued use of the Application after such updates constitutes acceptance of the modified Terms.

8.2. We may modify, suspend, or discontinue any aspect of the Application at any time without liability.
